European Small Claim Procedure

European Small Claims Procedure (ESCP) is a judicial tool to enforce consumer rights. ESCP could provide supplementary help to consumers when all amicable attempts to solve a dispute have failed. The procedure is regulated by the Regulation (EC) No 861/2007.

 

The European Small Claims Procedureis a proper judicial procedure, facilitating access to justice for every consumer who might face a cross-border dispute. It is a simplified procedure in civil and commercial matters where the value of a claim does not exceed 5000 €. The Regulation applies between all Member States of the European Union with the exception of Denmark.

 

The Small Claims Procedure operates on the basis of standard forms. It is a written procedure unless an oral hearing is considered necessary by the court.  For more detailed information please visit e-Justice portal.
